MODEL CONSENT AND AUTHORIZATION TERMS

Davines S.p.A. (“Davines”), with offices in Parma, Italy, Via Don Angelo Calzolari 55/A, intends to run Talent Green House contest for talented hairstylists from all over the world (“Stylists”). You have been involved by your Stylist as a model to create, perform and present with a video and photos his/her work. Davines would like to use images/videos of Stylist’s work to run the contest and in connection with the development and promotion of the Davines brand and the Davines products and is hereby asking your authorization.

To provide your consent you will have to fill in the below “Identification Form” and tick the box “I have read and I accept the Model Consent and Authorization Terms”, after having carefully read this document.

By providing your consent:

1. You, irrevocably, unconditionally and perpetually authorize Davines S.p.A., and third parties who are authorized by Davines to use, reproduce, publish, distribute, represent, disseminate, modify, your portrait/images as depicted in the video and the nine images taken by the Stylist and uploaded therein, in whole or in part, in any form and manner whatsoever, in each and every activity that Davines will consider appropriate in connection with the running of the Talent Green House contest and the development and promotion of the Davines brand and the Davines products. By way of example only, these activities may include digital marketing and/or advertising in webpages, newsletters or social media (including e.g. reposting, regramming; resharing, etc.) of Davines or of third parties. I understand and accept that no limitation applies to such authorized uses with respect to time, territory or media.
2. You represent and warrant that you are of legal age (18 or above);
3. You acknowledge and consent that the above mentioned uses by Davines will be royalty free and that you will not receive any direct or indirect monetary compensation therefore neither any credit or mention;
4. You acknowledge and consent that, the authorization above does not represent any commitment by Davines to use your portrait/images;
5. You acknowledge and consent that this authorization shall be governed by Italian Law and that any dispute arising in connection thereto shall be subject to the exclusive jurisdiction of the Court of Milan, Italy.

Once the process is completed, you will receive at the email account you will have provided in the Identification Form a copy of these Model Consent and Authorization Terms for your reference and archive.

Pursuant to article Reg. EU 2016/679 – G.D.P.R. General Data Protection Regulation Articles 12, 13, 14 and following, the Data Subject declares that Davines S.p.A. has informed him/her that his/her personal data, including his/her picture/image, provided in relation to the authorization provided with the Consent Form (hereinafter, “Personal Data”) will be processed by Davines S.p.A. in order to exercise the rights referred to in this Consent Form. The conferment of Personal Data for such purposes is obligatory and any refusal will affect the possibility of executing the provisions of the Consent Form completed and accepted. The Personal Data may be disclosed to third parties appointed by Davines S.p.A. that will act as Responsible (appointed) or authorized to process. The processing is done by collecting, recording, organizing, consulting and storing data in appropriate archives protected by appropriate security measures. Operations can be performed with or without the aid of electronic or automated tools. The Personal Data may be communicated to parties appointed (also as Responsible, Article 28) both nationally and internationally with the appropriate security and organizational measures adopted.

The Data Subject was aware that at any time he/she has the right to obtain confirmation of the existence or otherwise of such Personal Data and to know its content and origin, verify its accuracy or request its integration or updating, or correction, request the identification details of the data controller and of the parties to which the data can be communicated (Reg. EU 2016/679 - GDPR General Data Protection Regulation articles 12, 13, 14 and following). Pursuant to said regulation on personal data protection, the Data Subject is aware that he/she has the right to request cancellation, transformation into anonymous form or blocking of data processed in violation of the law, and to oppose to processing in any case for legitimate reasons.
